If you have been injured during the course of your employment you may be entitled to various benefits regardless of whose fault the accident was. These benefits may cover medical and rehabilitation expenses, and compensate you for the loss of your weekly wage. Workers’ compensation also covers diseases caused by your employment.
If you are the dependant of someone who has died because of a workplace injury, you may also be entitled to lump-sum compensation.
Was your injury someone else’s fault?
Was your injury someone else’s fault or caused by someone else’s negligence? (It may be your employer’s fault, or that of another person.) If that injury has caused you permanent and serious impairment, you may be entitled to claim additional compensation.
It is important to note that Tasmanian law provides that only seriously injured workers are able to recover common law damages.
How does the process work?
You need to tell your employer about your work injury as soon as possible. You must inform them before leaving their employment (unless your injury has developed gradually since your departure). Your employer must legally tell you of your right to make a workers’ compensation claim, and give you a workers’ compensation form.
